NDBACE is authorized to investigate possible violations of the State Statute ND Century Code and the NAADAC/NCC AP Code of Ethics governing licensed addiction counselors. Anyone may file a complaint against a LAC if they believe there is grounds to do so.

The Board has authority to revoke or suspend a license, place restrictions or limitations on the scope of practice, require retraining or other appropriate remedies to ensure the LAC practices safely and competently. The Board’s jurisdiction extends only to a licensee, their license and practice.

NDBACE reviews each complaint to determine whether a violation of law or regulation may have occurred. If deemed necessary, an investigation is initiated by an ethics sub-committee. Based on their recommendation, the Board will determine if there is reasonable basis to believe the licensee engaged in unacceptable conduct. NDBACE will either dismiss the complaint or offer an informal resolution to the licensee. Learn more about the complaint process.
